Terms and Conditions of www.erosescort4u.com

1. The website of www.erosescort4u.com (the „Website”) is designed to be used only by adults of sound mind.

2. Ads may only be published on the Website by adults of sound mind.

3. The Website enables visitors and its registered users to upload, publish and view ads, however the Website is not a party or an agent.

4. The content of the Website is intended for information purposes only and may not be interpreted as a business offer.

5. Registration, viewing and using some of the services offered on the Website is free and voluntary.

6. Each user is obliged to read these Terms and Conditions carefully before using the Website.

7. By using this Website the users give their acceptance of all Terms and Conditions and undertake to comply with them.

8. Users publishing any materials in any form on the Website authorise other users to view them. If the uploaded and published materials should correspond to the definition of a piece of work, protected by law under the Polish Act of 4 February 1994 on copyright and related rights (the „Copyright Law”, Journal of Laws No. 90/2006, Item 631, as amended), the user grants the Website Administrator a free of charge, non-exclusive licence to use the piece of work for the purposes of the Website and waives any claims against the Website Administrator if the piece of work is actually used.

9. Neither the Website Administrator nor the Website Operator shall be responsible for the content and the nature of the ads published on the Website.

10. The Website Administrator reserves the right to deny access to the Website for users who do not comply with its Terms and Conditions.

11. The domain name of the Website, its content, logo, graphic design, software solutions and data base are protected by law.

12. The Website Administrator reserves the right to publish advertising, promotional and/or marketing content on the Website.

Uploading and publishing ads

1. Users of the Website shall be solely responsible for the content of their ads, photographs and any information shown in their ads. Users publishing ads declare that they have the right to use the photographs and information contained in their ads.

2. On www.erosescort4u.com the ads are displayed in a random order and each user can see them in a different sequence.

3. A single ad may only contain details and photographs of one person, except for the ads published in the sections intended for duos, couples and clubs.

4. In order to be published an ad must contain at least two photographs. The maximum size of a single image may not exceed 20 MB.

5. The Website Administrator reserves the right to reject or remove an ad without stating the reason.

6. Upon a request of the user publishing an ad (the „Advertiser”) the ad may be removed or modified by the Website Administrator before its expiry date.

7. Ads are published for the period of 30 days. The price for a 30-day run of an ad is PLN 35.00.

8. The Advertiser declares that all the content of the ad is correct and true and that it does not violate any third-party rights.

9. The Advertiser agrees to the publication of the content of the ad, including photographs and personal data, by displaying of the same on the Website (www.erosescort4u.com) and authorises the Website Administrator or Operator to use the photographs and contact details for Website-related marketing purposes.

10. Seven (7) days before the expiry date of the ad the Advertiser shall be reminded by e-mail.

11. The Website may only be used according to its purposes. Any abuse is prohibited.

12. It is prohibited to publish photographs and content violating the local and international laws.

13. It is prohibited to publish photographs of third parties.

14. The Website Administrator reserves the right to retain the fee paid by a user (Advertiser) when the user decides to stop the run of the ad or when the ad is removed due to a violation of the Terms and Conditions.

15. It is prohibited to advertise any services and products without a prior consent of the Website Administrator.

16. Ads that do not comply with the Terms and Conditions may be – at the Administrator’s option – corrected to ensure their compliance or removed.

17. Any attempts to break the law or to assume the identity of another user/person shall be reported to the relevant law enforcement authorities. 18. Upon expiry the ad becomes invisible to other users of the Website. 19. The Website Administrator reserves the right to retain the fee even if the run of the ad has been stopped before its expiry date.

Registration

1. Each user has the right to register at www.erosescort4u.com free of charge and voluntarily.

2. Each Registered User has the right to post comments and to vote – once a week – for the Ad of the Week and the Video of the Week.

3. In order to register the user must read, understand and accept the Terms and Conditions, enter their Username, Password and e-mail address. 4. By registering and entering the Website the user shall indicate acceptance of the Terms and Conditions.

5. The e-mail address provided by the registering user is not visible to any third parties.

6. It is prohibited to use foul and offensive language and to register a Username that may be regarded as such.

7. By using the Website the user agrees to receive notifications using e-mail or SMS.

8. It is prohibited to copy the whole or any parts of the Website without a written consent of the Website Administrator.

Rights and obligations

1. Each user has the right to view and modify their data and to have their account deleted upon request.

2. The Website Administrator shall not be responsible for the accuracy of the ads, however all efforts shall be made to ensure that the ads published on the Website provide true and correct information.

3. The Website Administrator shall not be responsible for third-party acts or their misuse of the user/Advertiser data published on the Website.

4. The Website Administrator shall not be responsible for the content provided by the users of www.erosescort4u.com.

5. The Website Administrator shall not be responsible for disturbances or malfunctions of the service caused by hardware failures, acts of God or unlawful or unauthorised access of users, and reserves the right to retain any fees paid by users if such disturbances or malfunctions should occur.

6. The Website Administrator shall not be responsible for the loss of user data caused by system faults, hardware failures and/or breaking-in by third parties.

7. The Website Administrator shall not be responsible for breaks in publishing of the ad where they have been caused by system faults or hardware failures.

8. The Website Administrator shall not be responsible for publishing of photographs of or containing third parties.

9. Each user has the right to complain as regards the functioning of the Website and the services offered.

10. The Website Administrator has the right to block or delete the account of the user who does not respect the Terms and Conditions.

Final provisions

1. These Terms and Conditions become effective on 25.02.2011.

2. The Administrator of www.erosescort4u.com reserves the right to change or amend the content of the Terms and Conditions, notifying all its Registered Users accordingly by e-mail.

3. By using the Website of www.erosescort4u.com the users accept the Terms and Conditions as amended from time to time.

4. The applicable law shall be the law of Poland, including the Civil Code and the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144/2002, Item 1204, as amended).
